Very curious about this site and it's legitimacy. After reading their terms and conditions I was a bit spooked. Curious to hear any updates you have on the service. Here's the part of the Terms and Conditions that was a bit off to me...

Pretty much says they can do whatever they want with an artists image. Thoughts?

WTF?!?! I can not beilive this. How is that possibile that people are still using it? As far as I know they don't need all those rights to keep social network going - or do they?
ReplyDeleteDepends. If they decide to create a sub-network or display things on a sister site, e.g. nineteen84 (?) or something, they wouldn't need to ask you for permission. It also means that they could show your profile on your ads and stuff.
ReplyDeleteIt's pretty liberal but you need it in this way to not shoot yourself in the foot in advance.
Like, is creating a thumbnail transformation or not? What about watermarking the photo or creating a giant collage/visualizations of your users photos, etc. You just don't want to limit yourself.
Copyright in digital age is totally foo concept :/
Josh, Jernej, Jure - thanks for your thoughts. I must say I am a bit shocked by this (obviously I didn't read the terms and conditions when I join the network, and I'm sure I'm not the only one!)
ReplyDeleteI have no problem with the terms that artists content can be used for a promotional use of the site, or any newsletters that this site has for their users ... blablabla. But they pretty much say I would have to be "Ok" that my photograph is used in a stupid porn ad - for instance.
Well, let's wait what @nineteen74 has to say about this on Twitter ... I'm waiting!
Hey guys, just reading your comments on our terms and conditions, all social networking sites including Nineteen74, where u upload imagery need to have this clause written in their terms, that doesnt mean we are able to use your works outside our network,or even are allowed to sell it but as Jure says correctly it does need to stated , if somebody visits your profile and grabs an image via screen shot we can not be made liable.Or as we showcase talent within nineteen74, we are able to make you famous! If we use any images outside nineteen74 we HAVE to ask your consent e.g. newsletter or our newly launched magazine...
ReplyDeleteWith todays technology we are unable to protect peoples work from our side and cant monitor all user behaviour, so hopefully you give us the credit that we can use images on the site to create business for individuals within our Nineteen74 network:) As Jure says Watermarking your images is the only way to protect... and all we do need is protect us from evil thoughts :)
The only way to have your work today clearly save is to print it on photopaper and lockin your cupboard.... And all nineteen74 is for to showcase the indivudual to make them more known in a gloabl community
